The unlicensed driver who killed an electrical worker in Queens yesterday has been charged with vehicular manslaughter, DWI, and resisting arrest, according to the NY Post. The victim, 63 year old Frank Avino of Long Island, was hit and killed at approximately 11 a.m. yesterday morning on the Grand Central Parkway.
This blog has previously discussed the definition of DWI and vehicular manslaughter in New York State. Resisting arrest, a Class A Misdemeanor, is defined in the Penal Code as “intentionally prevent[ing] or attempt[ing] to prevent a police officer or peace officer from effecting an authorized arrest of himself or another person.” Penal Law Section 205.30. A Class A Misdemeanor carries a punishment of up to one year in jail.
