On Monday night, a Brooklyn father was struck by a hit and run driver. The pedestrian later died of his injuries from the accident. Police arrested the driver of the vehicle several blocks later, and according to NY1, charged him with leaving the scene of an accident. It was unclear from the report if further charges are pending against the motorist.
As we have discussed previously, when the driver of a motor vehicle causes personal injury to another individual, the driver has a duty to identify himself to the injured party. N.Y. Vehicle and Traffic Law section 600(2)(c)(ii) further states that where the personal injury involved results in death, it “shall constitute a class D felony punishable by a fine of not less than two thousand nor more than five thousand dollars in addition to any other penalties provided by law.” Additional penalties could include prison time, should law enforcement decide that additional charges are warranted.
