Anastomotic Leak After Bariatric Surgery: How Failure to Diagnose Becomes Medical Malpractice in New York

Anastomotic Leak After Bariatric Surgery

by Thomas Gallivan 22 Sep2026

Bariatric surgery has helped thousands of New Yorkers achieve significant weight loss and improve health conditions related to obesity. Procedures such as gastric bypass and sleeve gastrectomy can dramatically reduce the risk of diabetes, heart disease, sleep apnea, and other serious illnesses. Like any major surgery, bariatric procedures carry risks, such as the potential for an anastomotic leak.

When stomach contents, digestive fluids, or bacteria escape through a leak in the gastrointestinal tract, patients can quickly develop life-threatening infections, sepsis, and organ failure. The difference between a full recovery and a catastrophic outcome often depends on how quickly healthcare providers recognize the warning signs and intervene. If a delayed diagnosis of an anastomotic leak leads to serious injury, patients may have grounds for a medical malpractice claim under New York law.

At the Law Offices of Thomas L. Gallivan, we represent patients and families harmed by preventable medical negligence. If you have suffered an injury due to a delayed diagnosis or failure to diagnose, we will fight to help you get the compensation that you deserve. Contact our law firm today to schedule a free initial consultation with a New York medical malpractice lawyer.

What Is an Anastomotic Leak?

An anastomosis is the surgical connection between two sections of the digestive tract. During procedures such as a Roux-en-Y gastric bypass, surgeons divide portions of the stomach and small intestine before reconnecting them to create a smaller stomach pouch and reroute digestion.

An anastomotic leak occurs when this surgical connection fails to heal properly, allowing gastric contents or intestinal fluids to leak into the abdominal cavity. These leaks may develop because of:

  • Poor blood supply to the tissue
  • Excessive tension on the surgical connection
  • Technical errors during surgery
  • Infection
  • Breakdown of staples or sutures
  • Tissue weakness
  • Patient-specific risk factors

Although relatively uncommon, anastomotic leaks are among the most feared complications in bariatric surgery because they can rapidly become fatal if not recognized promptly. A missed or delayed diagnosis of an anastomotic leak may be a form of medical malpractice.

Which Bariatric Procedures Can Cause an Anastomotic Leak?

Anastomotic leaks can occur after several types of weight-loss surgery, including:

  1. Gastric Bypass (Roux-en-Y): Because gastric bypass involves multiple surgical connections, it carries one of the highest risks for anastomotic leaks.
  2. Sleeve Gastrectomy: Although sleeve gastrectomy does not create an intestinal anastomosis, leaks may occur along the staple line where the stomach has been divided.
  3. Revisional Bariatric Surgery: Patients undergoing revision surgery generally face higher complication rates due to scar tissue, altered anatomy, and previous surgical changes.
  4. Duodenal Switch Procedures: These complex procedures involve multiple gastrointestinal connections that may also develop postoperative leaks.

Regardless of the procedure performed, early recognition of a potential leak is critical. With early diagnosis and treatment, the risk of serious or fatal complications is reduced.

Why Anastomotic Leaks Are Medical Emergencies

The gastrointestinal tract contains bacteria, digestive enzymes, and stomach acids that should remain inside the digestive system. When these substances leak into the abdominal cavity, patients may develop:

  • Peritonitis
  • Severe infection
  • Absecesses
  • Sepsis
  • Septic shock
  • Organ failure
  • Respiratory failure
  • Multi-organ failure

Without rapid treatment, mortality rates increase dramatically. Even patients who survive may experience permanent complications requiring additional surgeries and prolonged hospitalization.

Common Symptoms of an Anastomotic Leak

Early symptoms of an anastomotic leak may be subtle. Healthcare providers treating postoperative bariatric patients are expected to recognize warning signs. This may include:

  • Rapid heart rate (tachycardia)
  • Fever
  • Abdominal pain
  • Shoulder pain
  • Chest pain
  • Difficulty breathing
  • Low blood pressure
  • Nausea
  • Vomiting
  • General weakness
  • Restlessness
  • Confusion
  • Decreased urine output

One of the earliest and most important warning signs is persistent tachycardia. Many bariatric surgery experts consider an elevated heart rate in the postoperative period a red flag that should never be ignored.

Why Delayed Diagnosis Happens

Despite well-established medical guidelines, anastomotic leaks continue to be missed by healthcare professionals. Several breakdowns in patient care may contribute, such as:

  1. Symptoms Are Dismissed as Normal Recovery: Some patients are told that pain, nausea, or fatigue are expected after surgery. While mild discomfort is common, persistent or worsening symptoms require careful evaluation.
  1. Inadequate Monitoring: Hospitals must appropriately monitor postoperative patients for signs of deterioration. Failure to observe changes in the following vital signs may delay life-saving treatment:
    • Heart rate
    • Temperature
    • Oxygen levels
    • Blood pressure
    • Respiratory status
  1. Failure to Order Diagnostic Tests: Patients showing symptoms suggestive of a leak often require prompt diagnostic testing. These may include:
    • CT scans with oral contrast
    • Upper gastrointestinal contrast studies
    • Blood tests
    • Repeat imaging
    • Surgical exploration when necessary

Failure to order appropriate tests may constitute negligence.

  1. Poor Communication: Sometimes nurses recognize concerning symptoms, but physicians are not notified promptly. In other cases, communication failures occur during:
    • Shift changes
    • Hospital discharge
    • Transfers between departments
    • Emergency room evaluations

Any communication breakdown can delay diagnosis.

  1. Premature Hospital Discharge: Some patients are discharged before postoperative complications become obvious. When patients call with concerning symptoms after returning home, providers must take those complaints seriously. Telling a patient to simply “watch and wait” when warning signs exist can have devastating consequences.

The Consequences of Delayed Treatment for an Anastomotic Leak

Every hour matters once an anastomotic leak develops. Delayed diagnosis may result in:

  • Emergency reoperation
  • Intensive care admission
  • Mechanical ventilation
  • Sepsis
  • Kidney failure
  • Liver damage
  • Multiple abdominal surgeries
  • Long-term nutritional problems
  • Permanent digestive complications
  • Extended hospitalization

Some patients spend months recovering from complications that could have been minimized through earlier intervention. In some cases, a patient dies from a delayed diagnosis of an anastomotic leak (potentially leading to a wrongful death claim).

When Does Failure to Diagnose Become Medical Malpractice?

Not every poor medical outcome constitutes malpractice. Under New York law, a healthcare provider may be liable for medical negligence when they fail to provide treatment consistent with accepted medical standards and that failure causes patient harm.

In delayed diagnosis cases involving anastomotic leaks, malpractice may occur when providers fail to recognize signs that a reasonably competent physician would have investigated. Examples include:

  • Ignoring persistent tachycardia
  • Failing to evaluate postoperative fever
  • Misdiagnosing sepsis
  • Failing to order imaging
  • Delaying consultation with the operating surgeon
  • Sending patients home despite obvious warning signs
  • Misreading diagnostic studies
  • Delaying emergency surgery

Each case requires careful review by qualified medical experts. If an expert agrees that an injury was likely caused by medical negligence, then the patient may pursue a medical malpractice claim under New York law.

Several healthcare providers may share responsibility for a delayed diagnosis. Potential defendants in an anastomotic leak medical malpractice case include:

  • Bariatric Surgeons: Surgeons have a duty to monitor patients appropriately after surgery and respond promptly to concerning symptoms.
  • Emergency Room Physicians: Patients frequently seek emergency care after discharge. ER physicians should recognize that recent bariatric surgery changes the evaluation of abdominal complaints.
  • Hospitals: A hospital or surgical center may be liable for:
    • Inadequate staffing
    • Poor nursing care
    • Failure to follow protocols
    • Communication failures
    • Delayed physician notification
  • Radiologists: Diagnostic imaging plays a critical role in spotting an anastomotic leak. Misinterpreting CT scans or contrast studies can delay treatment.
  • Nurses: Nurses are often the first to recognize patient deterioration. Failure to report significant changes may contribute to patient injury.

How Hospitals Can Prevent Anastomotic Leak Injuries

Most delayed diagnosis cases are preventable, including those involving anastomotic leaks after bariatric surgery. Healthcare facilities can reduce patient harm by implementing evidence-based safety practices, including:

  • Standardized postoperative monitoring protocols
  • Early warning systems for abnormal vital signs
  • Rapid response procedures for suspected leaks
  • Prompt access to CT imaging
  • Immediate surgical consultation
  • Comprehensive discharge instructions
  • Clear communication among care teams
  • Education regarding postoperative warning signs

Patients should also receive written instructions explaining when to seek immediate emergency care after bariatric surgery. For example, patients recovering from bariatric surgery should never ignore worsening symptoms. They should seek immediate medical attention if they experience:

  • Rapid heartbeat
  • Fever
  • Severe abdominal pain
  • Difficulty breathing
  • Persistent vomiting
  • Dizziness
  • Confusion
  • Fainting
  • Increasing weakness

Prompt evaluation may prevent life-threatening complications.

" I was a passenger on a motorcycle and ended up falling off the back of the bike due to the driver acting like an idiot. I fell off at a high rate of speed and was very banged up. Fractured wrist and road rash down my back and elbows. I am lucky I didnt die. Not knowing what to do I contacted Thomas and he could not have been anymore helpful!! He went out of his way to meet with me. He actually came to my house for the initial consultation. I know nothing about law or what my options even were. He took me through everything step by step.
