$500,000 Pedestrian Accident - Westchester County

Plaintiff, a 65-year-old retired engineer from China, was walking on Pelham Rd. in New Rochelle, approaching the intersection of Centre Ave when he was struck by defendant's vehicle as she exited the driveway of her apartment building.  Plaintiff suffered a bicondylar fracture of the right tibial plateau requiring open reduction and internal fixation with two plates and 15 screws and a fractured left radial styloid requiring casting. He was hospitalized for 30 days. Thereafter, he was placed in a Bledsoe brace, was non-weight bearing for several months, and required the use of a quad cane.  Plaintiff claimed that as a result of his injuries, he was at a significant risk for arthritis and was recommended for a total knee replacement surgery.

$188,333 Slip & Fall Settlement - Westchester County

Plaintiff, a 49 year-old, self-employed carpenter, fell and sustained injuries after stepping into a small trench in front of a friend's residence in North Salem. Plaintiff was returning from a stroll at the time of the accident. He stepped over the curb and into an adjacent trench, which was 10 to 12 inches in length.  Plaintiff sued the town of North Salem and Bee & Jay Plumbing and Heating Corp., which had installed a water line on Sunset Drive a year prior to the accident.  Plaintiff sustained a bimalleolar fracture of his right ankle, which was treated with open reduction and internal fixation with six screws and a plate. Two additional screws were placed in the medial malleolus, and plaintiff wore a short leg cast for six weeks. His orthopedist has recommended hardware-removal surgery.

CRIMINAL DEFENSE RESULTS

Criminal - Not Guilty Verdict - Westchester County: PSNY v. Confidential

Defendant was originally charged with felony assault.  The charge was subsequently reduced to a misdemeanor and the matter was tried.  The jury returned a not guilty verdict after a four day trial.

Criminal - Charges Dismissed - Westchester County: PSNY v. Confidential

Defendant was charged with Criminal Mischief in the Fourth Degree and Assault in the Third Degree, both Class A Misdemeanors.  After extensive discovery and preparation for Trial, the charges were dismissed on the day of the scheduled Trial.

Criminal - Bronx County: PSNY v. Confidential

Resulting from an investigation by the Attorney General of the State of New York, client was charged with Grand Larceny 2nd and was extradited from Florida to face charge. Unable to make bail, client was confined to jail for four months while counsel was attempting to resolve her case. Facing a maximum jail sentence for a "C" felony of up to 15 years and restitution of over $370,000.00, a plea was entered whereby a sentence of time served (4 months), probation, and a fine of $10,000 was imposed.

DWI/Criminal - Westchester County: PSNY v. Confidential

Defendant was arrested and charged with Aggravated Unlicensed Operation of a Vehicle in the First Degree, an E Felony, and two counts of driving while intoxicated, both Misdemeanors.  After negotiating with the District Attorney's Office on behalf of the defendant, a plea of guilty was entered to two violations (not crimes), and the defendant was sentenced to a fine/surcharge and a conditional discharge.

Accused of Burglary 3rd, a class "D" felony as a second felony offender and facing up to 7 years in State Prison, after extensive preparation and preliminary hearings, the matter was tried. The client was found not guilty and released.

Criminal - Westchester County: PSNY v. Confidential

Faced with two Felony charges of Trademark Counterfeiting and four years in prison, a plea to Disorderly Conduct and a fine was obtained for this client after several conferences with the District Attorney's Office pointing out the search and seizure defects in their case.

Defendant was charged with Criminal Mischief in the Fourth Degree, a Class A Misdemeanor.  Facing a maximum sentence of one year in jail, the charge was dismissed by the Court.
